SB1383 Exemption Waivers

State of California Short-Lived Climate Pollutants Law (SB1383)
Granada Community Services District (GCSD) will be shifting from education to enforcement of Californai Senate Bill 1383 (SB 1383) this June. While access to recycling and organics services has been mandated by laws AB 341, AB 1826, and District Code Ordinance 175, SB 1383 aims to significantly reduce methane emissions and rescue edible food waste from landfills.
Multi-family dewellings and commercial businesses within the District are obligated to comply with some or all of the organic waste requriements of SB 1383 and Ordinance 177. However, the District may allow, at its option, to grant waivers to generators under the following circumstances:
1. De Minimis Waiver – for businesses (including multi-family residential dwellings) that generate a minimal amount of compostable/organic waste (food scrpas, food-soiled paper, and plant debris). There are two thresholds for qualifying for a De Minimis Waiver, depending on the amount of waste your business generates:

Less than 2 cubic yards of total weekly service . | Generate no more than 10 gallons of compostable/organic waste per week. |
2 or more cubic yards of total weekly service. | Generate no more than 20 gallons of compostable/organic waste per week. |
2. Physical Space Waiver - for businesses (including multi-family residential dwellings) that can demonstrate that the premises lack adequate space for the collection containers. The District must have evidence from its own staff, a hauler, licensed architect, or licensed engineer.
Starting in June of 2025, any business not currently subscribed to organics recycling will either need to subscribe to that service or apply for and be granted a waiver by GCSD. Completion of the application does not guarantee an approved waiver. District staff will review the waiver request and evaluate.
